Welcome to Dorkaholics. These Terms of Service (“Terms”) govern your access to and use of Dorkaholics.com and any websites, features, content, or services operated by Dorkaholics that link to these Terms (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.

1. About Dorkaholics

Dorkaholics is an entertainment publication providing news, interviews, reviews, commentary, videos, event coverage, and other editorial content relating to entertainment and pop culture, including film, television, anime, comics, gaming, and related subjects.

Content published by Dorkaholics is provided primarily for informational and entertainment purposes.

2. Eligibility and Use of the Site

You may use the Site only in compliance with these Terms and applicable laws.

You agree not to:

  • Use the Site for unlawful, fraudulent, or abusive purposes;
  • Attempt to gain unauthorized access to the Site, its servers, accounts, or related systems;
  • Interfere with the operation or security of the Site;
  • Introduce malware, malicious code, or other harmful technology;
  • Scrape, crawl, harvest, or systematically extract Site content or data through automated means except as permitted by applicable law or with our authorization;
  • Impersonate another person or organization;
  • Use the Site to distribute spam or unsolicited commercial communications;
  • Infringe the intellectual property, privacy, publicity, or other rights of another person; or
  • Use Dorkaholics content in a manner that falsely suggests sponsorship, endorsement, affiliation, or approval by Dorkaholics.

We may restrict or terminate access to the Site when reasonably necessary to protect Dorkaholics, our visitors, our systems, or third parties.

3. Editorial Content

Dorkaholics publishes journalism, interviews, reviews, commentary, opinion, and other editorial material.

We endeavor to provide accurate information, but entertainment information can change quickly. Release dates, casting information, event schedules, pricing, product availability, specifications, streaming availability, and other information may change after publication.

We do not warrant that all information published on the Site is complete, accurate, or current at all times.

Dorkaholics may correct, update, clarify, edit, or remove published material when appropriate.

4. Opinions and Interviews

Reviews, columns, commentary, and other opinion-based content reflect the views of their respective authors unless otherwise stated.

Statements made by actors, filmmakers, developers, creators, executives, interview subjects, or other third parties are their own statements and do not necessarily represent the views of Dorkaholics.

Likewise, opinions expressed by individual contributors do not necessarily represent the views of Dorkaholics as an organization.

5. Dorkaholics Intellectual Property

Unless otherwise indicated, original articles, written editorial content, original photography, original video, graphics, logos, branding, website design elements, and other materials created and owned by Dorkaholics are protected by copyright, trademark, and other applicable intellectual property laws.

You may access Dorkaholics content for your personal, noncommercial use.

Except as permitted by applicable law, you may not reproduce, republish, distribute, sell, commercially exploit, or create unauthorized derivative works from Dorkaholics-owned content without permission.

Brief quotations and links to Dorkaholics articles may be used where permitted by applicable law and appropriate attribution practices.

Nothing in these Terms is intended to restrict rights available under copyright law, including fair use.

6. Third-Party Intellectual Property

Dorkaholics covers entertainment properties owned and created by third parties. Accordingly, the Site may contain third-party trademarks, logos, photographs, screenshots, artwork, trailers, video clips, promotional materials, embedded content, or other third-party intellectual property.

Third-party materials remain the property of their respective owners.

References to companies, franchises, products, characters, games, films, television programs, creators, or other third-party properties do not imply ownership, sponsorship, or endorsement by Dorkaholics unless expressly stated.

Dorkaholics may use or display third-party materials pursuant to permission, license, press or promotional authorization, embedding functionality, applicable law, or other lawful bases.

7. Materials Provided to Dorkaholics

Studios, networks, publishers, game developers, public relations agencies, brands, creators, representatives, and other parties may provide Dorkaholics with press releases, photographs, trailers, screeners, artwork, product information, review materials, or other assets (“Press Materials”).

When you provide Press Materials to Dorkaholics for editorial, publicity, review, or promotional consideration, you represent that you have the authority to provide those materials for their intended purpose.

Unless expressly agreed otherwise, providing Press Materials does not guarantee that Dorkaholics will publish, review, feature, or otherwise use them.

Dorkaholics retains editorial discretion over whether and how to cover a subject.

8. Editorial Independence

Receiving review copies, press access, event admission, travel accommodations, products, promotional items, or other benefits does not guarantee favorable coverage.

Dorkaholics maintains editorial discretion regarding its coverage, reviews, recommendations, headlines, ratings, interview questions, and opinions.

Where appropriate or required, Dorkaholics may disclose material relationships associated with editorial or commercial content.

9. Advertising, Sponsorships, Affiliate Links, and Promotional Relationships

Dorkaholics may display advertising or publish content associated with commercial relationships.

These may include:

  • Display advertising;
  • Sponsored content;
  • Paid partnerships;
  • Affiliate links;
  • Promotional campaigns;
  • Brand collaborations;
  • Complimentary review products;
  • Complimentary event access;
  • Press trips; or
  • Other commercial or promotional arrangements.

Where required by applicable law or appropriate journalistic practice, Dorkaholics will endeavor to provide disclosures identifying material commercial relationships.

Advertisements displayed through third-party advertising networks do not necessarily constitute an endorsement by Dorkaholics of the advertiser, product, or service.

Purchases or transactions made through third-party advertisers, retailers, or affiliate links are transactions between you and the applicable third party.

10. User Comments

The Site may allow visitors to leave comments or otherwise participate in discussions.

You remain responsible for content you submit.

You agree not to submit content that:

  • Is unlawful;
  • Threatens or harasses another person;
  • Is defamatory;
  • Is intentionally deceptive or fraudulent;
  • Contains spam;
  • Infringes copyrights, trademarks, privacy rights, publicity rights, or other rights;
  • Contains malicious software or harmful code;
  • Publishes another person’s private information without authorization; or
  • Otherwise violates these Terms.

Dorkaholics may moderate, edit, hide, disable, or remove comments at our discretion, including comments that we consider abusive, disruptive, off-topic, spam-like, or otherwise inappropriate for the community.

We are not obligated to publish or preserve any comment.

11. License for User-Submitted Content

You retain ownership of content you submit to Dorkaholics.

When you intentionally submit content for public display on the Site—for example, by posting a comment—you grant Dorkaholics a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and promote the Site and display the content you submitted.

This license does not transfer ownership of your content to Dorkaholics.

If you separately submit professional work, photography, video, articles, pitches, or other creative materials for potential publication, any publication rights may instead be governed by a separate written agreement or arrangement between you and Dorkaholics.

12. Story Tips, Pitches, and Unsolicited Submissions

Dorkaholics may accept story tips, pitches, press releases, interview opportunities, or other submissions.

Submitting material does not guarantee:

  • A response;
  • Publication;
  • An interview;
  • Review coverage;
  • Confidentiality; or
  • Compensation.

Do not send confidential or proprietary information unless Dorkaholics has expressly agreed to receive it on a confidential basis.

This section does not grant Dorkaholics ownership of intellectual property contained in an unsolicited submission.

13. Contests and Giveaways

Dorkaholics may occasionally operate contests, sweepstakes, giveaways, or other promotions.

Individual promotions may be subject to separate official rules, eligibility requirements, deadlines, prize terms, and other conditions.

Where specific promotion rules conflict with these Terms regarding that promotion, the specific promotion rules will control.

Third-party platforms used to promote a giveaway, such as social media platforms, are not sponsors or administrators of a Dorkaholics promotion unless expressly stated.

14. Third-Party Websites and Services

The Site may contain links to or embedded content from third-party websites and services, including social networks, streaming platforms, retailers, ticketing services, advertisers, game publishers, entertainment companies, and other websites.

Dorkaholics does not control those third parties.

We are not responsible for their availability, accuracy, products, services, security, terms, privacy practices, or content.

Your interactions with third-party websites and services are governed by the terms and policies of those third parties.

15. Copyright Complaints

Dorkaholics respects intellectual property rights.

If you believe material appearing on the Site infringes your copyright, please contact us with sufficient information for us to evaluate the claim.

A copyright notice should include, as applicable:

  1. Identification of the copyrighted work claimed to have been infringed;
  2. Identification and location of the allegedly infringing material on Dorkaholics;
  3. Your name and contact information;
  4. A statement explaining the basis for your claim;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
  6. A statement that the information in your notice is accurate and, where required by law, that you are authorized to act on behalf of the copyright owner; and
  7. Your physical or electronic signature where required.

Dorkaholics reserves all rights and defenses available under copyright law. Submission of a copyright complaint does not constitute an admission by Dorkaholics that the disputed material infringes any right.

16. Trademarks

“Dorkaholics,” associated logos, and other Dorkaholics branding may be trademarks or otherwise protected brand identifiers of Dorkaholics.

Third-party trademarks appearing on the Site belong to their respective owners.

Nothing on the Site grants you a license to use Dorkaholics trademarks or third-party trademarks except as permitted by applicable law or with permission from the applicable rights holder.

17. Privacy

Your use of the Site is also subject to the Dorkaholics Privacy Policy, which explains our practices regarding personal information, cookies, analytics, advertising technologies, and other data-processing activities.

The Privacy Policy is incorporated into these Terms by reference.

18. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

DORKAHOLICS MAKES NO WARRANTY THAT THE SITE WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ALL INFORMATION ON THE SITE WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DORKAHOLICS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

Dorkaholics is not responsible for losses resulting from reliance on third-party information, third-party services, advertisements, external websites, or transactions with third parties accessed through the Site.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Dorkaholics and its owners, officers, employees, contractors, contributors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms, or content you submit that violates another person’s rights.

This provision does not require you to indemnify Dorkaholics for conduct for which indemnification cannot lawfully be required.

21. Changes to or Availability of the Site

Dorkaholics may modify, suspend, discontinue, or change portions of the Site at any time.

We may also remove, update, archive, correct, or modify content.

We do not guarantee that any particular article, video, comment, feature, or service will remain available indefinitely.

22. Changes to These Terms

We may update these Terms periodically to reflect changes in our Site, business practices, legal requirements, or services.

When we update these Terms, we will change the “Last Updated” date above.

Your continued use of the Site following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

23. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where applicable law requires otherwise.

Any dispute relating to these Terms or the Site will be subject to the jurisdiction of the state or federal courts having appropriate jurisdiction in California, except where applicable law provides otherwise.

24. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will remain in effect.

25. No Waiver

Failure by Dorkaholics to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

26. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly applicable to particular features or promotions, constitute the agreement between you and Dorkaholics concerning your use of the Site.

Separate written agreements between Dorkaholics and contributors, advertisers, contractors, sponsors, partners, or other parties are not superseded by these Terms unless the applicable agreement states otherwise.
